PictureUs Terms of Service

These Terms of Service (“Terms”) govern access to PictureUs websites, applications, APIs, and related services (collectively, the “Services”) operated by PictureUs Labs and its affiliates (collectively, “PictureUs,” “we,” “us,” or “our”). By using the Services, you agree to these Terms and our Privacy Policy.

You must be able to form a binding contract under applicable law. If you are under the age of majority, parental or guardian consent may be required where mandated by law. We do not knowingly collect personal information from children under 13 (or a higher age if required in your jurisdiction) without compliant consent.

We may modify these Terms by posting an updated version with a new “Last updated” date. If changes are material and adverse, we will provide reasonable advance notice where required by law. Continued use after the effective date constitutes acceptance.

Features, plans, generation caps, satisfaction-cut requirements, timelines, and specifications are described in the product UI, checkout pages, and help center and may change. We may modify or discontinue features; beta or free features may end without liability.

You are responsible for account credentials and for all activity under your account. Notify us promptly of unauthorized use.

- “User Input” means photos, metadata, prompts, and other materials you submit. - “Deliverables” means images and other outputs generated for you.

You represent and warrant that: (i) you own or have all rights, licenses, and consents for User Input; (ii) for every identifiable person in a composite, you have obtained their informed consent to processing and generation; (iii) for minors, you have obtained verifiable parental/guardian consent where required.

You grant PictureUs a non-exclusive, worldwide, royalty-free license to host, copy, process, analyze, and display User Input to provide and secure the Services, including session-specific personalized modeling (e.g., LoRA training). We do not cross-use your User Input to train models for other customers’ sessions except as expressly described in the Privacy Policy and consent screens.

Separate, affirmative consent is required for general model improvement, marketing using identifiable likenesses, or other uses beyond service delivery, unless permitted by law and disclosed.

- Deliverables: To the extent permitted by law and subject to these Terms, you own the IP rights in Deliverables you lawfully obtain through the Services, excluding PictureUs’ underlying software, models, and branding. - PictureUs IP: All rights in the Services, software, and brands remain with PictureUs. No implied licenses except as stated.

You may need to retain AI-content disclosures where required (e.g., metadata, invisible watermarking policies described in product documentation).

THE SERVICES USE GENERATIVE AI. DELIVERABLES MAY BE INACCURATE, INCOMPLETE, OR NOT PHOTOREALISTIC. PICTUREUS DOES NOT WARRANT THAT DELIVERABLES WILL MATCH REAL PERSONS OR MEET ANY SPECIFIC PRINTING OR ID-PHOTO STANDARD. DELIVERABLES ARE NOT LEGAL, MEDICAL, OR FINANCIAL ADVICE. YOU USE OUTPUTS AT YOUR OWN RISK.

You must not use the Services for non-consensual intimate imagery, harassment, fraud, impersonation of others (including celebrities), illegal surveillance, or violations of law. We may remove content, suspend accounts, and cooperate with authorities as required.

Prices, taxes, currency, and payment methods are shown at checkout. Payments may be processed by third-party processors (e.g., Stripe); their terms also apply.

Except as required by law or as explicitly stated at checkout for your plan (including any satisfaction-guarantee terms such as full refund if you do not reach the stated number of satisfaction cuts before hitting the generation cap), all fees are non-refundable once Deliverables are made available or you confirm satisfaction (including by downloading high-resolution files if that action is designated as confirmation in your plan terms).

Non-waivable rights under the laws of your country or state (for example, certain EU or U.S. state consumer laws) remain unaffected.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICTUREUS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/DATA, ARISING FROM THE SERVICES. PICTUREUS’ TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) U.S. $100, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW (E.G., GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR PERSONAL INJURY).

You will defend, indemnify, and hold harmless PictureUs from claims arising out of your User Input, your use of Deliverables, or your breach of these Terms.

The formation and interpretation of these Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules, except that mandatory consumer protection laws of your country or state of residence (including the United States) apply to the extent required and cannot be waived.

- If you are habitually resident in the Republic of Korea, you and PictureUs consent to the exclusive jurisdiction of the Seoul Central District Court (subject to non-waivable rights to sue elsewhere). - If you are habitually resident in the United States, disputes may be brought in state or federal courts located in Delaware, USA, unless mandatory law requires a different forum. (If PictureUs later adopts arbitration, it will be introduced through a clear, separate amendment and notice.)

Nothing in this Section limits either party’s right to seek injunctive relief for IP or security issues where permitted.

Third-party links and processors are governed by their own terms.

If any provision is invalid, the remainder remains enforceable. These Terms constitute the entire agreement regarding the Services to the extent permitted by law. Assignment by you is void without consent; PictureUs may assign in connection with a merger or sale.
